Comparative Study on Domestic and Foreign Regulations Related with the Range of Isomers of Narcotics

Abstract
This study aims to discover and propose things need to be considered for improvement in relation to designation of isomers of narcotics under¡¸Narcotics Control Act¡¹of Korea by comparing and analyzing the range of isomer in the United Nations (UN) and foreign countries (United States and United Kingdom). For this purpose, the definition and the ranges of isomers defined by the Conventions on Narcotics of the UN (Single Convention on Narcotic Drugs 1961 and Convention on Psychotropic substances 1971), the Controlled Substances Act of the United States and the Misuse of Drugs Act 1971 of the United Kingdom were investigated and compared with domestic regulations. The UN sets the isomer ranges of narcotics and psychotropic substances differently but generally limits them to stereoisomers. In the United States, isomer range is based on stereoisomers, although it is set differently depending on the objective, and constitutional isomers (positional isomers) are partially recognized for specific groups of substances with defined ranges. In the United Kingdom, the isomer range is specified as stereoisomers. Unlike investigated international organization or foreign countries, Korea does not clearly define the term or the range of isomers for narcotics in the ¡¸Narcotics Control Act¡¹or the related regulations. Therefore, it is considered appropriate to clearly define the definition and the scope of isomers of narcotics, by referring to overseas regulations and considering domestic regulatory environment.
